MPS service rules, responsibilities of the parties, and limits of legal liability.
The MPS (Structural Production Management) Portal provides analytical tools for managing work estimates, quality control of ceramic materials, and planning deliveries to industrial sites. The service includes software modules accessible through the alotugla.com website, without including direct consultancy or physical execution of works.
"User" means any individual or legal entity accessing the platform, and "contractor" designates the user who enters into a service agreement with MPS. The term "materials" refers exclusively to ceramic blocks and primary resources from quarries, as defined in the platform's technical documentation.
The user undertakes to provide accurate and complete data upon registration, including valid contact information and details about the projects for which they use MPS tools. Any changes to the data must be communicated within 5 working days.
The user is responsible for the security of their account, including maintaining the confidentiality of the password and for all activities carried out under that account. MPS is not liable for unauthorized access caused by user negligence.
MPS makes reasonable efforts to ensure the correct functioning of the platform, but does not guarantee that the service will be uninterrupted or error-free. Planned maintenance interruptions will be announced at least 48 hours in advance.
MPS's liability for direct damages caused by improper use of the tools is limited to the value of the subscription paid in the last 12 months. MPS is not liable for indirect losses, such as delays in project execution, additional transport costs, or the contractor's contractual penalties.
Data generated by the platform (estimates, quality reports, delivery plans) is for informational purposes and does not constitute official certification documents. The user is responsible for verifying compliance with applicable standards in the construction field.
MPS may suspend or terminate a user's access in the event of a serious breach of the terms, including providing false data, hacking attempts, or using the platform for illegal activities. In such cases, the user will be notified by email, and the account will be deactivated within 24 hours.
The user may request the deletion of their account and associated data at any time, by a written request to the contact address. MPS will process the request within 30 days, except for data necessary to fulfill legal obligations (e.g., tax invoices).
MPS reserves the right to update these terms and conditions. Users will be informed at least 14 days before the changes come into effect, by notification on the website or by email. Continued use of the platform after this period constitutes acceptance of the new terms.
